1. The service provider and what these terms cover
The provider is Drif Core, 286 Bondi Rd, Bondi NSW 2026, Australia, [email protected], +61 2 9114 7372. These terms cover use of drifcore.com, enquiries sent through it, and the delivery of event programs described on it. Individual events are governed by the signed contract for that event; where the contract and these terms differ, the contract applies.
2. Definitions
- Event – the program delivered at a venue on an agreed date.
- Program – the guest-facing hours of activity, excluding set-up and pack-down.
- Package – the crew, equipment, styling and hours listed with a format.
- Enquiry – a request for availability and a quote. It is not a booking.
- Client – the company or individual who signs the contract.
- Chip – a prop token used in themed activities. It has no denomination and no value.
- Free-play credits – the internal balance on which a hired machine operates.
3. The nature of the service
We provide offline entertainment programs at a venue chosen by the client. The service is not gambling within the meaning of the Interactive Gambling Act 2001 (Cth), or of the gaming and wagering legislation of the state or territory in which the event is held. Specifically:
- chips and credits are props: they are not sold, cannot be bought or topped up, and are not exchanged for money, goods, vouchers or any other item of value;
- there are no stakes of money or property and no cash or prize winnings;
- the outcome of an activity gives a participant no financial benefit;
- where machines are hired, they operate on their own internal free-play credits and any note or coin acceptor is disabled or absent;
- there is no online casino and no play over the internet;
- participation is limited to guests aged 18 and over.
The full house rules for these programs are on the responsible entertainment page.
4. Using this site and the form
- Content on this site is provided for information. Prices shown are indicative planning prices, not offers capable of acceptance.
- The enquiry form may be used to request availability and a quote. Do not submit anyone else personal information without their knowledge.
- Automated submission, scraping and attempts to interfere with the site or the form are not permitted.
- Text, layout and photographs on this site belong to us or are used with permission, and may not be copied for commercial use.
5. Enquiry, quote and contract
- Sending an enquiry does not hold a date and creates no obligation on either side.
- We reply with availability and a written quote naming the date, the venue, the package, the hours and the total including GST.
- A date is held only once the contract is signed and the deposit is received. Until then the date remains available to others.
- Changes agreed after signature are recorded in writing and, where they change the price, in a revised quote.
6. Prices and payment
- Prices published on this site are indicative planning prices for the whole event, not per guest, and include GST.
- The price of a package does not change because fewer guests attend than planned.
- The price assumes a suitable venue provided by the client, normal access, one local run and the standard set-up window.
- What is included and what is organised separately is listed on the pricing page and repeated in the quote.
- Payment terms: a 20-40% deposit once the contract is signed, the balance 5-10 days before the event.
- Invoices are issued for both the deposit and the balance.
7. Preparation and delivery
- The client provides the venue and its furniture, power, amenities and access, and confirms the venue house rules, noise conditions and curfew in writing before the date is held.
- The client secures any permission the venue or the site requires for the event itself.
- Set-up and pack-down happen inside the agreed window: set-up up to 3 hours before the event, pack-down 1-2 hours after. These hours are outside the program hours.
- We supply the crew, equipment, styling and program listed in the package, and a coordinator present for the program.
- Guest numbers above the limit stated for the format cannot be accepted on the night, because crew and equipment are booked to that limit.
8. Postponement and cancellation
- A postponement requested more than 30 days before the event is moved to a new date subject to availability, and the deposit carries over.
- A postponement requested inside 30 days is accommodated where crew and equipment can be rebooked; costs already incurred may be charged.
- On cancellation by the client, the deposit covers planning and crew commitments already made. Amounts beyond the deposit are charged only where they have actually been incurred and are evidenced.
- If we cannot deliver the event for a reason within our control, the deposit is refunded in full.
- Exact figures and dates for a specific event are set out in that event contract.
9. Consumer rights
Nothing in these terms excludes, restricts or modifies any consumer guarantee or other right that cannot lawfully be excluded, including the consumer guarantees that apply to services supplied in Australia. Because an event is arranged for a specific date and venue, there is no general cooling-off period: cancellation and postponement work as set out in clause 8 and in the event contract.
10. Complaints
- Send a complaint to [email protected] with the event date, the venue and what went wrong.
- We acknowledge within 2 business days and respond substantively within 14 days.
- If a complaint cannot be resolved between us, either side may pursue the remedies available under the law of the applicable jurisdiction.
11. Liability and events outside our control
- We are responsible for delivering the package with reasonable care and skill, and for the conduct of our crew on site.
- We are not responsible for the condition, licensing or safety of the venue, for catering and drinks, or for the conduct of guests.
- Neither side is liable for failure caused by an event outside its reasonable control, including extreme weather, a public emergency, a power failure at the venue or the venue becoming unavailable. In that case we agree a new date or refund amounts not yet committed.
- Where a format is run outdoors, the wet-weather plan agreed in the run sheet applies, including who makes the call and when.
12. Final provisions
- These terms are governed by the law of the State of New South Wales, Australia, and the courts of that state have jurisdiction, unless the event contract states otherwise.
- If any clause is unenforceable, the rest stays in force.
- These terms take effect on the date shown at the top of this page. The version in force is the one published when the contract is signed.
